Job description.
Under the supervision of the Litigation Manager, the incumbent will be responsible for assisting the litigation manager in reducing the company's litigation risks, by providing expert legal advice and overseeing the procedural and substantive aspects of each dispute involving KCC. As a legal expert, the senior legal counsel Litigation will work closely with the various relevant departments of KCC as well as with external advisors, including lawyers.
He/She will have, among other things, the following essential functions (non-exhaustive):
• Analyze and monitor all KCC litigation: Review legal opinions from external counsel, assess possible contexts and outcomes, and formulate recommendations;
• Research relevant legislation and business information: Assess the validity of claims, particularly pre-litigation, and present the strategy to management;
• Identify and supervise internal corrective actions: Propose corrective measures and monitor their implementation validated by management;
• Work closely with internal stakeholders: Obtain all information related to business activities within the required timeframes;
• Manage litigation documentation : Ensure all documents are properly archived and easily accessible;
• Anticipate disputes and take proactive measures : Prepare and plan the management of potential conflicts;
• Participate in negotiations with external lawyers: Act as an interface between KCC and opposing parties during negotiations;
• Oversee ongoing litigation: Track all files, coordinate legal and logistical support, and communicate with external counsel;
• Represent the company when needed: Be present in court to support external counsel and ensure KCC is properly represented;
• Maintain an up-to-date register of disputes and report to management: Provide a weekly bilingual (French/English) report on the progress of files.
Job requirements .
Qualifications and experience.
• Hold a bachelor's degree in law (minimum 5 years of study);
• Have at least 6 years of experience as a lawyer or company legal advisor specializing in private litigation in the Democratic Republic of Congo (DRC);
• Have experience in the mining industry, which would be a major asset;
• Fluent in French, English and Swahili.
Technical skills
• Master the laws applicable in the DRC, including OHADA law, tax legislation and local legal procedures;
• Knowledge of relevant corporate litigation laws, including mining law, environmental law, civil law and labor law;
• Be an expert in the Congolese judicial system, including procedural law and judicial structures.
