Job description

 

Under the direct supervision of the Operational Investigations Supervisor, the incumbent will conduct investigations within the Legal Investigations department. They will be responsible for collecting, analyzing, and documenting information and evidence related to incidents or alleged offenses, in accordance with applicable laws and internal procedures. In collaboration with relevant departments and competent authorities, they will also contribute to identifying and preventing risks that could affect the company.

 


His/Her essential functions will include, among others (non-exhaustive list):

 

•    Conduct the operational investigations entrusted to him, day and night, in accordance with the established rotation system and internal procedures.
•    To take action in strict compliance with criminal procedure, especially with regard to the arrests and detention of intruders and internal persons (KCC agents and contractors) against whom abuses of the law have been established;
•    To ensure reassurance and control over the proper handling of arrested individuals with regard to human rights requirements as well as occupational health and safety.

•    Maintain the criminal identification system and potentially report on cases of recidivism.
•    Collect, analyze and document facts relating to incidents, alleged offences and breaches of company policies and procedures.
•    Conducting interviews with complainants, witnesses and affected persons, in compliance with legislation, confidentiality and principles of professional ethics.

•    To intervene quickly in the event of a major incident in order to preserve the premises, collect relevant information and secure evidence.
•    Collect, record, preserve and transmit evidence while ensuring strict adherence to the chain of custody.
•    Prepare clear, accurate, objective and legally sound investigation reports, then submit them to the Operational Investigations Supervisor for review and validation.

•    Ensure the maintenance, updating, traceability and secure archiving of investigation files, in accordance with internal procedures and applicable regulations.
•    Ensure that all investigative activities are conducted in compliance with the laws of the Democratic Republic of Congo, KCC's internal policies, fundamental rights and confidentiality rules.
•    Collaborating with the Legal, Security, Human Resources, Surveillance and Intelligence departments to ensure coordinated management of incidents and investigations.

•   To collaborate, when required and authorized, with judicial services, law enforcement and other competent authorities.
•    Analyze information and survey results to identify recurring trends, risks, and patterns of operation.
•    Formulate recommendations aimed at preventing the recurrence of incidents, reducing risks and strengthening internal controls.

•    Participate in the collection and analysis of information relating to internal and external threats that may affect the company.
•    To ensure the administrative and documentary follow-up of persons apprehended and handed over to the competent authorities, in compliance with legal and internal procedures.
•    Contribute to the prevention and management of incidents that may affect the company's relationships with local communities.

•    Perform any other task related to operational investigations that may be assigned to him by his superiors.

 

 

Job requirements 

 

Qualifications and experience

 

•    Hold a graduate or bachelor's degree in law, criminology, political and administrative sciences, security management or a related field.
•    Demonstrate at least two (2) to three (3) years of professional experience in the field of judicial investigations, internal investigations, legal counsel , compliance or industrial custody.
•    Possess a good understanding of criminal law, investigative procedures and the rules applicable to arrest, custody and the preservation of the rights of the persons concerned.

•    Having a good knowledge of the organization and functioning of the judicial system, in particular the organization and jurisdiction of the courts.

•    Having a good knowledge of labor law, and especially with regard to the disciplinary process in professional environments.
•    Experience in conducting investigations in a company, mining sector or industrial environment is an asset.

 

Technical skills.

 

•    Good understanding of criminal law; general, special, criminal procedure in the DRC , disciplinary and judicial investigation procedures , legal compliance and principles of procedural fairness.
•    Ability to conduct interviews and collect statements in a professional, impartial and structured manner.
•    Excellent analytical, observational and problem-solving skills, particularly in sensitive or high-pressure environments.

•    Proficiency in writing clear, concise, objective and legally sound investigation reports.
•    Knowledge of the procedures for collecting, recording, storing and transmitting evidence.
•    Good knowledge of chain of custody protocols and best practices in internal investigations.

•    Ability to analyze available information, establish facts, and formulate conclusions based on verifiable evidence.
•    Excellent written and oral communication skills in French; proficiency in English and local languages is an asset.
•    Ability to work independently, while respecting instructions from superiors and established deadlines.

•    Ability to work on a rotating schedule, including nights, weekends and holidays, when required by the needs of the service.
•    Proficiency in Microsoft Office, including Word, Excel and PowerPoint, as well as survey management tools.
